Chief Executive of China's Hong Kong Special Administrative Region (HKSAR) Carrie Lam on Tuesday addressed the UN Human Rights Council via video message, calling on the international community to respect China's right to safeguard national security and HK people's aspirations for stability and harmony.
Speaking at the opening of the 44th session of the UN Human Rights Council, Carrie Lam stressed that the legislation to safeguard national security is now urgently needed.
The chief executive said that Hong Kong is an inalienable part of China -- a special administrative region enjoying a high degree of autonomy which comes directly under the central government, but Hong Kong has not been able to fulfill its constitutional duty. For the sake of not only the 7.5 million Hong Kong residents, but also the 1.4 billion people in the Chinese mainland, "the question of how long we could tolerate such a gaping hole in national security has to be asked, and answered."
Since last June, she said, Hong Kong has been traumatized by escalating violence fanned by external forces. During this period, groups advocating "Hong Kong independence" and "self-determination" incited protesters to desecrate and burn the national flag, vandalize the national emblem and storm the central government's office in Hong Kong.
Further, some local politicians proclaimed that they would paralyze the HKSAR government while others campaigned for foreign governments to interfere in Hong Kong's affairs or even to impose sanctions on Hong Kong.
Saying that these acts have crossed the "One Country" red line, Lam called for resolute action. She said no central government could turn a blind eye to such threats to sovereignty and national security as well as risks of subversion of state power.
She told the Council that as the highest organ of state power in China, the National People's Congress has the constitutional power and the duty to enact national security legislation for the HKSAR.
The legislation aims to prevent, curb and punish acts of secession, subversion of state power, terrorist activities, and collusion with foreign or external forces to endanger national security, Lam said.
"The law will not affect Hong Kong's renowned judicial independence. It will not affect legitimate rights and freedoms of individuals which are protected under the basic law and relevant international convenants applied to Hong Kong. They include, among others, the freedom of speech, of the press, of assembly, of demonstration and of procession," she said.
Upholding important legal principles, the legislation will not undermine "One Country, Two Systems" and Hong Kong's high degree of autonomy, she stressed.
"Hong Kong is a free and diversified society. We respect differences in opinion and thrive on reaching consensus. But the 'One Country' principle is non-negotiable and could not be compromised, as without 'One Country', 'Two Systems' will stand on shaky ground and Hong Kong's stability and prosperity will be at risk," said Lam.
She told the Council that for those foreign governments or politicians raising objections to the legislation, one could only lament the "double standards" they are adopting.
"All those countries that have pointed their fingers at China have their own national security legislation in place. We could think of no valid reason why China alone should be inhibited from enacting national security legislation to protect every corner of its territory and all of its nationals," she explained.
La chef de l'exécutif de Hong Kong, Carrie Lam, s'est adressée mardi par vidéoconférence au Conseil des droits de l'homme des Nations unies, appelant la communauté internationale à respecter l'aspiration des Hongkongais à la stabilité et à la prospérité.
S'exprimant à la 44e session du Conseil, Mme Lam souligné la nécessité impérieuse de mettre en place une loi de sécurité nationale à Hong Kong.
"Dans l’intérêt non seulement des 7,5 millions d’habitants de Hong Kong, mais aussi des 1,4 milliard d’habitants de la partie continentale, la question de savoir combien de temps nous pourrions tolérer un trou aussi béant dans la sécurité nationale doit être posée, et il faut y répondre", a-t-elle indiqué.
"La loi n'affectera pas l’indépendance judiciaire de Hong Kong. Elle n'affectera pas les droits et libertés légitimes des individus, qui sont protégés par la loi fondamentale et par les convenances internationales applicables à Hong Kong. Celle-ci comprennent, entre autres, la liberté d'expression, de la presse, d'association, de rassemblement et de procession. Autrement dit, la loi ne portera pas atteinte au principe 'un pays, deux systèmes' et au haut degré d'autonomie de Hong Kong", a expliqué la responsable.
Carrie Lam a également dénoncé la politique de "deux poids, deux mesures" de certains pays occidentaux, tout en défendant le droit de Beijing à protéger son territoire.
"Hong Kong est une société libre et diversifiée. Nous respectons les différences d'opinion et nous nous efforçons de parvenir à un consensus. Mais le principe 'un pays' n'est pas négociable et ne peut être compromis, parce que sans 'un pays', 'deux systèmes' se trouvera sur un terrain instable, la stabilité et la prospérité de Hong Kong seront menacées. Pour les gouvernements ou politiciens étrangers qui s'opposent à la loi, on ne peut que déplorer leur 'deux poids, deux mesures'. Tous les pays qui ont pointé du doigt la Chine ont mis en place leur propre législation en matière de sécurité nationale. Il n'y a aucune raison valable à ce que la Chine soit la seule à être privée d'une telle législation sur la sécurité nationale pour protéger toutes les parcelles de son territoire et tous ses ressortissants", a-t-elle poursuivi.
La jefa ejecutiva de la Región Administrativa Especial de Hong Kong (RAEHK) de China, Carrie Lam, instó ayer martes a la comunidad internacional a que respete el derecho de China a salvaguardar la seguridad nacional y las aspiraciones de los hongkoneses de estabilidad y armonía.
Lam hizo estas declaraciones al pronunciar un discurso en la apertura de la 44ª sesión del Consejo de Derechos Humanos de la Organización de las Naciones Unidas (ONU) a través de un enlace de video.
Tras enfatizar la urgencia de la legislación de seguridad nacional para Hong Kong, la jefa ejecutiva indicó que Hong Kong es una parte inalienable de China, una región administrativa especial dependiente directamente del gobierno central que disfruta de un alto grado de autonomía, pero no ha podido cumplir con su deber constitucional. Por el bien no solo de los 7,5 millones de habitantes hongkoneses, sino también de los 1.400 millones de personas en la parte continental de China, "la pregunta de cuánto tiempo podríamos tolerar un vacío tan grande en la seguridad nacional tiene que realizarse y ser respondida”.
Desde junio pasado, dijo Lam, Hong Kong se ha visto traumatizado por la escalada de violencia fomentada por las fuerzas externas. Incluyen, entre otros, las libertades de expresión, de prensa, de asamblea, de manifestación y de marcha", enfatizó.
Al defender importantes principios legales, la legislación no socavará el principio de "un país, dos sistemas" y el alto grado de autonomía de Hong Kong, subrayó.
"Hong Kong es una sociedad libre y diversificada. Respetamos las diferencias de opinión y hacemos esfuerzos por llegar a un consenso. Pero el principio de 'un país' no es negociable y no podría verse comprometido, ya que sin 'un país', los 'dos sistemas' se encontrarán en una posición precaria y la estabilidad y la prosperidad de Hong Kong estarán en riesgo", dijo Lam.
La jefa ejecutiva de la RAEHK también criticó el "doble rasero" que están adoptando aquellos gobiernos o políticos extranjeros que presenten objeciones a la legislación.
"Todos los países que han señalado con el dedo a China tienen su propia legislación de seguridad nacional. No se nos ocurre ninguna razón válida por la que solo China deba ser inhibida de promulgar una legislación de seguridad nacional para proteger cada rincón de su territorio y todos sus ciudadanos", recalcó.

وخلال كلمتها في افتتاح الدورة الرابعة والأربعين لمجلس حقوق الإنسان التابع للأمم المتحدة، شددت كاري لام على أن هناك حاجة ماسة الآن إلى تشريع لحماية الأمن القومي.
كما قالت الرئيسة التنفيذية إن هونغ كونغ جزء لا يتجزأ من الصين ومنطقة إدارية خاصة تتمتع بدرجة عالية من الحكم الذاتي وتخضع مباشرة للحكومة المركزية، غير أن هونغ كونغ لم تتمكن من الوفاء بواجبها الدستوري، مضيفة أنه من أجل ليس فقط 7.5 مليون من سكان هونغ كونغ، بل أيضًا 1.4 مليار نسمة في البر الرئيسي الصيني، "مسألة كم من الوقت يمكننا تحمل مثل هذه الثغرة في الأمن القومي، يجب أن تُطرح وأن تتم الإجابة عليها".
وذكرت أنه منذ يونيو الماضي، تعرضت هونغ كونغ لصدمة بسبب تصاعد العنف الذي أججته قوى خارجية، وأنه خلال هذه الفترة، حثت الجماعات التي تدعو إلى "استقلال هونغ كونغ" و "حق تقرير المصير" المتظاهرين على تدنيس العلم الوطني وحرقه، وتخريب الشارة الوطنية واقتحام مكتب إتصال الحكومة المركزية في هونغ كونغ.
علاوة على ذلك، أعلن بعض السياسيين المحليين أنهم سيشلون حكومة منطقة هونغ كونغ الإدارية الخاصة، بينما قام آخرون بحملة من أجل أن تتدخل حكومات أجنبية في شؤون هونغ كونغ أو حتى تفرض عقوبات عليها.
ودعت لام إلى اتخاذ إجراءات حازمة، قائلة إن هذه الأعمال تجاوزت الخط الأحمر لمبدأ "دولة واحدة". وأضافت أنه لا يمكن لأي حكومة مركزية أن تغض الطرف عن هذه التهديدات للسيادة والأمن الوطنيين وكذا عن مخاطر تخريب سلطة الدولة.
وفي نفس الوقت، صرحت لام بان المجلس الوطني لنواب الشعب الصيني باعتباره أعلى هيئة لسلطة الدولة في الصين، يتمتع بالسلطة الدستورية والواجب في سن تشريع للأمن القومي لمنطقة هونغ كونغ الإدارية الخاصة.
وتابعت لام أن التشريع يهدف إلى منع ووقف ومعاقبة الأعمال الانفصالية والتخريبية لسلطة الدولة، وكذا الأنشطة الإرهابية، والتواطؤ مع قوى أجنبية أو خارجية، التي تعرض الأمن القومي للخطر.
وأضافت:"لن يؤثر القانون على استقلالية القضاء الشهيرة في هونغ كونغ. ولن يؤثر على الحقوق والحريات المشروعة للأفراد المحميين بموجب القانون الأساسي ولا على المعاهدات الدولية ذات الصلة المطبقة في هونغ كونغ. وهي تشمل، من بين أمور أخرى، حرية التعبير والصحافة والتجمع والتظاهر والمواكب."
كما شددت على أن التمسك بمبادئ قانونية مهمة لن يقوض مبدأ "دولة واحدة ونظامان" ودرجة عالية من الحكم الذاتي في هونغ كونغ.
وأردفت: "هونغ كونغ مجتمع حر ومتنوع. نحن نحترم الاختلافات في الرأي ونسعى إلى التوصل لتوافق في الآراء. لكن مبدأ ’دولة واحدة‘غير قابل للتفاوض ولا يمكن الإخلال به، حيث أنه بدون مبدأ ’دولة واحدة‘، سيقوم ’نظامان‘ على أرض هشة وسيتعرض استقرار هونغ كونغ وازدهارها للخطر."
من جهة أخرى، أبلغت لام المجلس بأنه بالنسبة للحكومات الأجنبية أو السياسيين الذين يثيرون اعتراضات على التشريع، لا يمكن سوى التأسف على سياسة "المعايير المزدوجة" التي يتبنونها.
وأوضحت: "إن جميع البلدان التي وجهت أصابعها إلى الصين لديها تشريعات الأمن القومي الخاصة بها. وبالتالي، لا يوجد سبب وجيه يمنع الصين وحدها من سن تشريع للأمن القومي لحماية كل بقعة من أراضيها وجميع مواطنيها."
Глава администрации ОАР Сянган Линь-Чжэн Юеэ 30 июня выступила с видеообращением к Совету по правам человека ООН, призвав международное сообщество уважать право Китая на защиту государственной безопасности и желания жителей Сянгана жить в мире и спокойствии.
Выступая на открытии 44-й сессии Совета по правам человека ООН по видеосвязи, Линь-Чжэн Юеэ подчеркнула, что Сянган является неотъемлемой частью Китая. С июня прошлого года, по ее словам, Сянган страдал от вспышек насилия и массовых беспорядков, раздуваемых внешними силами. Некоторые из оппозиционных группировок угрожали парализовать работу администрации ОАР, еще некоторые обращались к иностранным правительствам с просьбой вмешаться в дела Сянгана. Подобные действия переступили всякие границы дозволенного. Глава администрации Сянгана подчеркнула, что правительства любых стран не стали бы закрывать глаза на такую угрозу суверенитету и национальной безопасности, на попытки подрыва государственной власти.
Линь-Чжэн Юеэ сообщила Совету, что ВСНП, будучи высшим органом государственной власти в Китае, обладает конституционными полномочиями и обязанностью разрабатывать законы в сфере защиты госбезопасности для ОАР Сянган.
Принятый Закон КНР о защите госбезопасности в ОАР Сянган направлен на предотвращение, пресечение и наказание преступных актов, включая раскол государства, подрыв государственной власти, террористическую деятельность, вступление в сговор с иностранными или внешними силами в целях нарушения государственной безопасности, сказала она, добавив, что таким образом данное законодательство направлено против небольшой группки людей, нарушающих закон, а также на защиту жизни, имущества, прав и свобод всех законопослушных жителей Сянгана.
"Закон не затронет известную [на весь мир] независимость судебной системы Сянгана. Он не повлияет на законные права и свободы отдельных лиц, которые находяться под защитой Основного закона и соответствующих международных конвенций, применяемых к Сянгану. Среди прочего, к ним [законным правам и свободам] относятся свобода слова, печати, собраний, демонстраций и шествий. Проще говоря, законодательство не будет нарушать принцип "одна страна, две системы" и высокую степень автономии Сянгана", – отметила глава администрации ОАР Сянган в своей речи.
Закон подтвердил свою приверженность основополагающему принципу законности и не противоречит курсу "одна страна, две системы" и принципу "высокой степени автономии" Сянгана, подчеркнула она.
"Сянган – это свободное и многоукладное общество. Мы уважаем разные точки зрения и способны к достижению консенсуса. Но принцип "одна страна" не подлежит обсуждению и не терпит компромиссов, поскольку без "одной страны" "две системы" окажутся в очень шатком положении, а стабильность и процветание Сянгана будут поставлены под угрозу. Что касается тех иностранных правительств или политиков, возражающих против этого закона, остается лишь сожалеть о "двойных стандартах", которые они применяют. Все те страны, которые указывали пальцем на Китай, имеют свое собственное законодательство в области госбезопасности. Мы так и не смогли придумать ни одной веской причины, по которой лишь Китаю необходимо препятствовать в принятии закона о госбезопасности для защиты каждого уголка своей территории и всех своих граждан", – констатировала Линь-Чжэн Юеэ.

Но принцип "одна страна" не подлежит обсуждению и не терпит компромиссов, поскольку без "одной страны" "две системы" окажутся в очень шатком положении, а стабильность и процветание Сянгана будут поставлены под угрозу. Что касается тех иностранных правительств или политиков, возражающих против этого закона, остается лишь сожалеть о "двойных стандартах", которые они применяют.
