The law on the Hainan Free Trade Port (FTP) adopted earlier this month is set to realize improved administration, liberalization and facilitation of trade, investment, streamlined taxation as well as environmental protection, among others, officials said when introducing the new law at a Monday press conference.

The law on the Hainan FTP, adopted by the National People's Congress Standing Committee on June 10, is widely seen as a move making institutional arrangements for the construction of the Hainan FTP at the national legislative level.

"First, in terms of delegated legislation and management mandate, the law stipulates that the country establishes a leadership mechanism for the FTP and an administrative system specially tailored according to its needs," said Wang Chaoying, member of the Standing Committee of the National People's Congress.

Wang added that under the new law, the State Council and relevant departments will promptly authorize or entrust the Hainan provincial government and relevant department to exercise administrative mandates in accordance with the law and their needs.

The law also authorizes Hainan people's congress and and its standing committee to formulate regulations on the FTP in accordance with this law and actual needs.

"Second, in terms of trade liberalization and facilitation, the law stipulates a commodity trade monitoring mode in which the front line will be liberalized while the second line will be controlled. Cross-border trade in services outside the negative list will be managed in accordance with the internal consistency, according to the law," said Wang.

"Third, in terms of investment liberalization and facilitation, the law promotes a streamlined approval and investment system to improve the investment promotion and protection mechanism. The law also strengthens IP protection and promotes the 'market access upon commitment' system. A negative list for foreign investment, especially for easy market access, will also be applied," he said.

"Fourth, in terms of the taxation system, the law follows the principles of simplifying taxation, zero tariff and low tax rates. It stipulates the requirements of simplifying taxation during and after custom clearance at the FTP, qualifications for exemption of custom duty, taxation arrangements for goods flowing between the inland and the FTP as well as preferential policies for eligible enterprises and personals' income taxation," said Wang.

Officials added that Hainan's natural environment is its greatest advantage, and its economic development must not be pursued at the expense of the environment.

"Fifth, the law stipulates that Hainan implements the strictest ecological and environmental protection institutions, adopting the one-vote veto system for environmental protection and lifelong accountability for damage to the ecological environment," said Wang.

The law also sets out institutional and policy systems for the FTP in terms of industry development, support for professionals and others, he said.

La loi sur le port de libre-échange de Hainan adoptée plus tôt ce mois devrait permettre d'améliorer l'administration, la libéralisation et la facilitation du commerce, les investissements, le système fiscal ainsi que la protection de l'environnement, a déclaré un responsable en présentant la loi lors d’une conférence de presse lundi.

La loi sur le port de libre-échange de Hainan, adoptée par le Comité permanent de l'Assemblée populaire nationale le 10 juin, est largement considérée comme une initiative visant à prendre des dispositions institutionnelles pour la construction du port au niveau législatif national.

"Premièrement, en ce qui concerne la délégation de la législation et les compétences de gestion, la loi stipule que le pays crée un mécanisme de leadership pour le port de libre-échange de Hainan et un système administratif spécial pour la construction du port", a déclaré Wang Chaoying, député du Comité permanent de l'Assemblée populaire nationale.

Закон КНР о Хайнаньском порте свободной торговли призван обеспечить улучшение административной системы порта, либерализацию и упрощение процедур торговли и инвестиций, упрощение налогообложения, а также укрепить защиту окружающей среды, заявили официальные лица, представляя новый закон сегодня, 21 июня, на пресс-конференции в Пекине.

Указанный документ, принятый Постоянным комитетом Всекитайского Собрания народных представителей (ПК ВСНП) 10 июня, широко рассматривается как шаг Китая, направленный на создание институциональных механизмов Хайнаньского порта свободной торговли на государственном законодательном уровне.

"Во-первых, с точки зрения делегированного законодательства и полномочий управления, закон предусматривает, что страна создает механизм руководства над строительством Хайнаньского порта свободной торговли и соответствующую систему административного управления", – отметил депутат ПК ВСНП Ван Чаоин во время представления содержания данного документа.

"Во-вторых, с точки зрения либерализации и упрощения процедур торговли закон предусматривает режим мониторинга и контроля торговли товарами, при котором торговля товарами на "первой линии" будет либерализирована (товары могут беспрепятственно ввозиться и вывозиться через границу без таможенного контроля), а "вторая линия" будет контролироваться (товары, ввозимые во внутренние районы Китая из порта или вывозимые из внутренних районов в порт, подлежат обложению соответствующими пошлинами). 　全国人民代表大会常務委員会で10日可決された『海南自由貿易港法』は、海南自由貿易港の建設のため制度的な手配の措置を全国の立法レベルで行うものとして広く注目されている。

　当局者は20日の記者会見で、『海南自由貿易港法』は、行政管理の改善、貿易・投資の自由化と円滑化、税制の合理化、環境保護などを実現することを目的としていると紹介した。

Das Anfang dieses Monats verabschiedete Gesetz über den Freihandelshafen Hainan (FTP) soll unter anderem eine verbesserte Verwaltung, die Liberalisierung und Erleichterung von Handel und Investitionen, eine vereinfachte Besteuerung sowie mehr Umweltschutz bewirken. Dies haben Offizielle am Montag auf einer Pressekonferenz zur Vorstellung des neuen Gesetzes gesagt.

Das vom Ständigen Ausschuss des Nationalen Volkskongresses am 10. Juni verabschiedete Gesetz über den Freihandelshafen Hainan (FTP) wird allgemein als ein Schritt angesehen, auf nationaler Gesetzgebungsebene institutionelle Vorkehrungen für den Bau des Freihandelshafens Hainan zu treffen.

„Erstens sieht das Gesetz in Bezug auf delegierte Gesetzgebung und Managementmandat vor, dass das Land einen Führungsmechanismus für den FTP und ein speziell auf seine Bedürfnisse zugeschnittenes Verwaltungssystem einrichtet“, sagte dazu Wang Chaoying, Mitglied des Ständigen Ausschusses des Nationalen Volkskongresses.

Der Staatsrat und die zuständigen Behörden würden nach dem neuen Gesetz die Regierung der Provinz Hainan und entsprechende Behörden unverzüglich ermächtigen beziehungsweise beauftragen, Verwaltungsmandate in Übereinstimmung mit dem Gesetz und ihren Bedürfnissen auszuüben, fügte er hinzu.

„Zweitens sieht das Gesetz im Hinblick auf die Liberalisierung und Erleichterung von Handel einen Überwachungsmodus für den Warenhandel vor, wonach die erste Reihe liberalisiert und die zweite Reihe kontrolliert werden soll. Der grenzüberschreitende Handel mit Dienstleistungen außerhalb der Negativliste wird nach dem Grundsatz der Übereinstimmung von innen und außen rechtmäßig gesteuert“, so Wang.

„Drittens fördert das Gesetz im Hinblick auf die Liberalisierung und Erleichterung von Investitionen ein vereinfachtes Genehmigungs- und Investitionssystem, um den Mechanismus zur Förderung und zum Schutz von Investitionen zu verbessern. Das Gesetz stärkt auch den Schutz des geistigen Eigentums und fördert das System des ‚Marktzugangs nach Zusage‘. Außerdem werden eine Negativliste für ausländische Investitionen sowie eine Liste für erleichterten Marktzugang angewendet“, sagte er.

„Viertens folgt das Gesetz in Bezug auf das Steuersystem den Grundsätzen der einfachen Besteuerung, der Nullzölle und der niedrigen Steuersätze. Es regelt die Anforderungen an die Vereinfachung der Besteuerung während und nach der Zollabfertigung am FTP, die Voraussetzungen für eine Zollbefreiung, die Besteuerung von Waren, die zwischen dem Inland und dem FTP fließen, sowie Vorzugsregelungen bei Einkommensbesteuerung für anspruchsberechtigte Unternehmen und Privatpersonen“, erklärte Wang weiter.

Dem Offiziellen zufolge sei Hainans natürliche Umwelt sein größter Vorteil. Seine wirtschaftliche Entwicklung dürfe daher nicht auf Kosten der Umwelt betrieben werden.

„Fünftens schreibt das Gesetz das strengste Umweltschutzsystem vor und führt das Ein-Stimmen-Veto-System zur Erreichung der Umweltschutzziele und ein System der lebenslangen Verantwortung für Umweltschäden ein“, sagte er.

Das Gesetz lege auch institutionelle und politische Systeme für den Freihandelshafen in Bezug auf Industrieentwicklung, die Unterstützung für Fachkräfte und anderes fest, so Wang weiter.
