China released a report on Monday that once again exposes significant fallacies in the so-called "South China Sea arbitration award" -- unilaterally initiated by the Philippines -- concerning legal interpretation and application, factual findings, and other aspects.
The report titled "A New Critique of the South China Sea Arbitration Award" was released at a roundtable dialogue on South China Sea security held in Hong Kong Special Administrative Region.
Ten years after the so-called "award" was issued in 2016, the illegality and absurdity of the "award", as well as the damage it has inflicted on China-Philippines relations and regional stability, have been fully exposed. A comprehensive cleanup of its lingering toxic effects is urgently needed.
The report provides a 10-year impact analysis and assessment of the so-called 2016 "South China Sea arbitration award." It offers an in-depth academic review and thorough "disinfection" of the "award". The report points out that over the past decade, the so-called "award" has very limited practical influence on state practice worldwide. Subsequent jurisprudence from international judicial and arbitral bodies has generally avoided citing the "award", and the academic community has largely been critical of its legal reasoning.
The release of the critique once again exposes the significant fallacies in the "award" regarding legal interpretation and application, factual findings, and evidentiary acceptance. It aims to help relevant countries recognize the true nature and dangers of the "award".
The report also shows that China's position of rejecting all claims and acts based on the "award" is just and legitimate. This stance is taken to safeguard China's maritime rights and entitlements in the South China Sea, uphold regional peace and stability, and defend the international rule of law.
Legal representatives and scholars from various countries and regions attended the event.
