China urged the EU to remove discriminatory requirements in its Industrial Accelerator Act; otherwise, countermeasures will follow, said a spokesperson of China's Ministry of Commerce (MOC) on Monday.
On Friday, the MOC formally submitted its comments on the EU's Industrial Accelerator Act to the European Commission, expressing the formal position and grave concerns of the Chinese side.
China argues that the Act imposes numerous restrictive requirements on foreign investment in four emerging strategic industries, namely batteries, electric vehicles, photovoltaics, and key raw materials. The Act also introduces exclusive "EU origin" clauses in public procurement and support policies, creating serious investment barriers and institutional discrimination.
In its comments, China pointed out four main issues with the Act:
First, it is suspected of violating fundamental principles such as most-favored-nation treatment and national treatment, and contravenes the rules of multiple agreements including the General Agreement on Tariffs and Trade 1994, the Agreement on Trade-Related Investment Measures, the Agreement on Trade-Related Aspects of Intellectual Property Rights, and the Agreement on Subsidies and Countervailing Measures.
Second, Chinese investors would face discrimination because of the Act, which runs counter to basic market economy principles such as voluntary business conduct and fair competition, and even more importantly, contradicts the significant consensus reached by Chinese and EU leaders on properly handling frictions and differences, seriously undermining the investment expectations of Chinese enterprises in Europe.
Third, it will slow down EU's green transition process, damage fair competition in the EU market, and bring new shocks to multilateral trade rules.
In the comments, China suggested that the EU side delete discriminatory requirements on foreign investors, local content requirements, mandatory intellectual property and technology transfer, and restrictions in public procurement policies from the Act.
It is hoped that EU will attach great importance to and seriously consider adopting the comments submitted by China, strictly abide by WTO rules, and avoid discriminatory restrictive measures.
China will closely monitor the legislative process and is willing to engage in dialogue and communication with EU on this issue, the spokesperson said.
However, if the EU side disregards China's suggestions, insists on pushing for its enactment, and thereby harms the interests of Chinese enterprises, China will have to take countermeasures to firmly safeguard the legitimate rights and interests of its enterprises, the spokesperson emphasized.
